Terms of Service

1. Acceptance of Terms

By accessing or using FashionModelAI ("the Service"), operated by FashionModelAI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We reserve the right to modify these terms at any time, and continued use of the Service constitutes acceptance of updated terms.

2. Description of Service

FashionModelAI is an AI-powered platform that transforms garment product photos into professional model photography. Users upload garment images, customize model appearance and settings, and receive AI-generated images of models wearing the garments.

3. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement. Parents or guardians are responsible for any use by minors under their supervision.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate content depicting minors (under 18) in any context
  • Create nude, pornographic, or sexually explicit content
  • Upload garment images you do not have the right to use
  • Generate images intended to deceive, defraud, or impersonate real individuals
  • Create content that promotes violence, hatred, or discrimination
  • Produce political misinformation or deepfakes
  • Violate any applicable local, state, national, or international law
  • Attempt to reverse-engineer, scrape, or extract the AI models or algorithms
  • Upload malware, viruses, or any disruptive code
  • Circumvent any security measures or access restrictions

6. Content Ownership & License

Your content: You retain ownership of all garment images you upload and the AI-generated images you create.

License to us: By uploading content, you grant FashionModelAI a non-exclusive, worldwide, royalty-free license to use, store, and process your uploaded images solely for the purpose of providing and improving the Service. We may use anonymized, aggregated data derived from usage to improve our AI models.

7. Credits & Payments

  • The Service operates on a credit-based system. Each generation consumes credits.
  • Plan credits renew each billing cycle. Unused plan credits do not carry over to the next cycle.
  • Credit top-up packs purchased separately are preserved and roll over month to month until used.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • Price changes will only apply after the current billing term ends.
  • You are responsible for any applicable taxes on purchases.

8. Refund Policy

Due to the nature of AI-generated content and the computational resources required, all sales are final. No refunds will be issued for credits that have been used. If you experience a technical issue that prevents generation, contact our support team and we will investigate and re-credit your account if appropriate.

9. Intellectual Property

The Service, including its design, logos, trademarks, AI models, and all underlying technology, is the exclusive property of FashionModelAI. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR SPECIFIC EXPECTATIONS.

11. Limitation of Liability

IN NO EVENT SHALL FASHIONMODELAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $500 USD, WHICHEVER IS GREATER.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Sections regarding ownership, liability, and dispute resolution survive termination.

13. DMCA & Copyright

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please contact us with a detailed DMCA takedown notice. Repeat infringers may have their accounts terminated.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FashionModelAI operates, without regard to conflict of law principles.
